Claims and warranty

  1. MTA Wedding Center is liable to the Customer if the sold product has a physical or legal defect (warranty). Where a physical defect consists in the non-conformity of the sold product with the contract or the Customer’s Specification. MTA Wedding Center shall be liable under the warranty if the physical defect is discovered before the expiry of 2 (two) years from the date of delivery of the product to the Customer. Any provision of this § 10 does not exclude or limit the rights of Customers. Purchasing products as Consumers, provided for in the applicable laws, including in particular Articles 556 – 576 of the Civil Code.
  2. MTA Wedding Center shall respond to the Customer’s complaint within 14 (fourteen) calendar days. On account of warranty and will notify him on the way of further proceedings.
  3. The warranty complaint should contain details of the person or entity submitting the complaint (name and surname or full name, contact details).   4. In the situation when the product was delivered through the Polish Post, courier company, the complaint under the warranty. (i.e. the advertised product, proof of purchase and description of complaint). It should be sent back to the address of the online shop (we recommend sending it through the Polish Post Office by registered mail or economy package).
  5. When the product has been collected in the MTA Wedding Center showroom, the complaints should be submitted in this showroom to the MTA Wedding Center, in which the collection of this product took place or according to the provisions of letter a above.
  6. If the complaint is considered in favour of the Customer – to MTA Wedding Center will immediately replace the defective product with a defect-free one or will remove the defect. This shall not affect the possibility of the Customer to submit a statement on price reduction or withdrawal from the contract in accordance with the provisions in force. If it is not possible to replace the product, remove the product defect or reduce the price to MTA Wedding Center will refund the amount due immediately in accordance with the applicable legislation.
  7. The Customer purchasing the product for the purpose directly related to his/her professional or business activity (Customer who is not a Consumer). Has the right to lodge a complaint in accordance with the legal provisions in force in this respect, whereby the liability to MTA Wedding Center under the warranty for physical defects of products is limited to the Customer’s entitlement to demand removal of the defect. In such a case, Atelier MTA Wedding Center shall, at its option, immediately replace the defective product with a free one. From defects or will remove the defect to MTA Wedding Center may also withdraw from the contract returning to such Customer who is not a Consumer the price paid for the product affected by the physical defect.
  8. For the rest, MTA Wedding Center’s warranty for product defects in relation to non-Consumer Clients is excluded. Subject to mandatory legal provisions, to the maximum extent permitted by law, the liability of MTA Wedding Center. MTA Wedding Center for damage caused to Customers who are not Consumers shall be limited to the amount Such Customer paid to MTA Wedding Center for the purchase of the product in question.

Warranty conditions

  1. MTA Wedding Center sells products which are covered by a guarantee for a period of 12 months. The guarantee (if the sold product is covered by it) does not exclude, limit or suspend the rights of the buyer resulting from the provisions on warranty for defects of the sold thing. For further information on the guarantee, please contact the Customer Service.
  2. In the case of a product for which the manufacturer, distributor or other guarantor has provided a guarantee, the customer may claim a product with defects:
    • by exercising his/her rights under the guarantee granted;
    • using his/her rights against the seller under the warranty – in such a case, a complaint should be filed in accordance with the provisions of these Regulations.

Order cancellation and withdrawal from The Contract

  1. The Customer may cancel the order until the order has been accepted for fulfilment, after agreeing the Specification by contacting the Customer Service.
  2. MTA Wedding Center sells products which are made on individual order according to the Customer’s Specification, after the order is accepted for realization (after the Specification is agreed with the Customer) the Consumer may not withdraw from the contract of sale of the product purchased in Online Shop
  3. The right of withdrawal does not apply to the Consumer in relation to the contract (pursuant to Article 38 of the Act of 30 May 2014 on consumer rights) for the provision of services, if the entrepreneur has performed the service in full with the express consent of the consumer, who was informed before the start of the service that after the performance by the entrepreneur will lose the right to withdraw from the contract;
  4. A consumer who wishes to exercise his right of withdrawal. He should inform the MTA Wedding Center of his decision to withdraw from the contract by an unequivocal statement. (e.g. a letter sent by post, fax or e-mail). The consumer may use the statutory model withdrawal form. Constituting Annex No. 2 to the Act of 30 May 2014 on consumer rights. The use of the above templates is not mandatory. To comply with the deadline for withdrawal. It is sufficient for the Consumer to send information concerning the exercise of his right of withdrawal before the expiry of the deadline for withdrawal.
